HIPAA NOTICE
Notice of Privacy Practices

This Notice applies to protected health information maintained by Nurture Sleep PLLC. You have a right to a paper or electronic copy of this Notice and may discuss it with our Privacy Officer using the contact information below.
Your Information. Your Rights. Our Responsibilities.
Your rights include the right to: inspect or obtain a copy of your medical record; request corrections; request confidential communications; request certain restrictions; obtain an accounting of certain disclosures; obtain a copy of this Notice; choose an authorized person to act for you; and complain if you believe your privacy rights have been violated.
1. Your Rights
Get an electronic or paper copy of your medical record
You may ask to inspect or obtain an electronic or paper copy of health information about you that we maintain in a designated record set. We will provide access as required by law. We may charge a reasonable, cost-based fee when permitted by law.
Ask us to correct your medical record
You may ask us to amend health information that you believe is incorrect or incomplete. We may deny the request in certain circumstances, but we will explain a denial in writing as required by law.
Request confidential communications
You may ask us to contact you in a specific way, such as at a particular telephone number, or to send communications to a different address. We will accommodate reasonable requests as required by law.
Ask us to limit what we use or share
You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations. We are not required to agree to every request. If you pay for a healthcare item or service out of pocket in full, you may ask us not to disclose information about that item or service to your health plan for payment or healthcare operations, and we will comply unless disclosure is otherwise required by law.
Get an accounting of certain disclosures
You may request an accounting of certain disclosures of your health information made during the six years before your request. The accounting generally does not include disclosures for treatment, payment, healthcare operations, disclosures you authorized, and certain other disclosures excluded by law. We will provide one accounting in a 12-month period without charge; a reasonable, cost-based fee may apply to additional requests where permitted.
Get a copy of this Notice
You may ask for a paper copy of this Notice at any time, even if you agreed to receive it electronically. The current Notice is also available on our website.
Choose someone to act for you
If a person has legal authority to act as your personal representative, such as under a valid healthcare power of attorney or guardianship, that person may exercise your privacy rights to the extent permitted by law. We may verify that authority before acting on a request.
File a complaint
You may complain to Nurture Sleep PLLC if you believe your privacy rights have been violated. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights (OCR). We will not retaliate against you for filing a complaint or exercising a privacy right.
2. Your Choices
For certain health information, you may tell us your preferences about what we share. For example, when applicable, you may tell us whether to share relevant information with family, friends, or others involved in your care or payment for your care, and whether to share information in a disaster-relief situation. If you are unable to tell us your preference, we may share information when permitted by law and when we determine that doing so is in your best interest.
For uses and disclosures that require your written authorization, including certain marketing activities or a sale of PHI, we will obtain authorization as required by law. You may revoke an authorization in writing, subject to actions already taken in reliance on it. If we conduct fundraising using PHI as permitted by HIPAA, you have the right to opt out of further fundraising communications.
3. How We May Use and Disclose Your Health Information
Treatment
We may use and disclose your health information to provide, coordinate, or manage your healthcare and to communicate with other healthcare professionals involved in your care.
Payment
We may use and disclose your health information to bill and obtain payment from health plans or other responsible parties and to conduct related payment activities.
Healthcare operations
We may use and disclose your health information for healthcare operations, including quality improvement, training, credentialing, compliance, auditing, business management, and other activities permitted by HIPAA.
Other uses and disclosures permitted or required by law
We may use or disclose health information as permitted or required by law, including for certain public health and safety activities, health oversight, judicial and administrative proceedings, law enforcement purposes, workers' compensation, organ and tissue donation, medical examiner or funeral director functions, research when legally permitted, and to avert a serious threat to health or safety. Applicable legal conditions and limitations will be followed.
4. Substance Use Disorder (Part 2) Records
HIPAA-covered healthcare providers and health plans that create or maintain records protected by 42 CFR Part 2 must include information about those records in their Notice of Privacy Practices. To the extent Nurture Sleep PLLC creates, receives, or maintains records protected by Part 2, we will use and disclose those records only as permitted by HIPAA, Part 2, and other applicable law. Part 2 records may be subject to protections and restrictions beyond those that apply to other health information, including restrictions on certain uses and disclosures in civil, criminal, administrative, and legislative proceedings against a patient.
When Part 2 requires consent or authorization for a use or disclosure, we will obtain it as required by law. You may contact our Privacy Officer with questions concerning protections applicable to Part 2 records.
5. Our Responsibilities
- We are required by law to maintain the privacy and security of your protected health information.
- We will notify you as required by law if a breach occurs that may have compromised the privacy or security of your unsecured protected health information.
- We must follow the duties and privacy practices described in the Notice currently in effect.
- We will provide a copy of this Notice upon request.
- We will not use or disclose your health information other than as described in this Notice unless you authorize us in writing or another use or disclosure is permitted or required by law.
6. Changes to This Notice
We may change the terms of this Notice, and the revised Notice may apply to health information we already maintain as well as information we receive in the future. The current Notice will be available upon request, at our office, and on our website.
